Terms of Service
These Terms of Service (“Terms”) are a contract between you and HACJAC Capital LLC, the Ohio limited liability company that operates PlusAutomation.ai (“PlusAutomation.ai,” “we,” “us”). By creating an account or using the platform, you agree to these Terms.
1. The Service
PlusAutomation.ai is a back-office automation platform for route-based and appointment-based service businesses. It connects to your existing tools — CRM, accounting, payments, email, SMS, direct mail — and runs the follow-ups, charges, reminders, and reports you configure.
2. Your Account
- You must be at least 18 years old and authorized to bind your business.
- You are responsible for everything that happens under your account, including the actions of any team members you invite.
- Keep your credentials confidential. Notify us immediately at h@hacjac.com if you suspect compromise.
- One login per person. Do not share accounts.
3. Fees & Billing
- Subscription fees are billed monthly in advance, unless you select an annual plan.
- Usage-based fees (direct mail, SMS, extra workflow runs) are billed in arrears at the end of each billing cycle.
- Payment is via the payment processor on file. You authorize us to charge that card for all fees owed.
- Failed payments may pause automations after a 6-stage escalation (email, SMS, in-app banner, account-owner call, service pause, service termination).
- Fees are non-refundable except as required by law or as explicitly offered. Pro-rated refunds are not issued for partial months.
- We may change pricing with 30 days notice. Notice goes to the billing email on file.
4. Your Data
You own your data. We only use it to run the platform for you. See our Privacy Policy for the full treatment.
You are responsible for the lawfulness of the data you import and the messages you send. You represent that you have the right to contact the customers on your list, and that your marketing complies with TCPA, CAN-SPAM, CASL, and similar laws in your jurisdiction.
5. Acceptable Use
You agree not to:
- Use the platform to send spam, harass anyone, or violate anti-solicitation laws.
- Upload malware, attempt to reverse-engineer the platform, or probe it for vulnerabilities without written permission.
- Circumvent rate limits, kill-switches, or quota enforcement.
- Resell access to the platform without a written partner agreement.
- Use the platform for any illegal activity.
We may suspend or terminate accounts that violate this section, with or without notice depending on severity.
6. Third-Party Integrations
The platform connects to third-party services — your accounting system, your field-service CRM, your payment processor, email/SMS/direct-mail providers, Google Business Profile, and others. Those services are governed by their own terms. We are not responsible for changes, outages, or data loss in a third-party service. If a partner revokes access, the automations that depend on it will stop working until you re-authorize.
7. Uptime & Support
- We target 99.5% monthly uptime, measured against the platform core (login, dashboard, automations engine).
- Scheduled maintenance is announced in advance when possible.
- Support is via email at h@hacjac.com. Response targets vary by plan.
- We are not liable for downtime of third-party integrations.
8. Intellectual Property
The platform, including all underlying software, UI, documentation, and trademarks (“PlusAutomation.ai,” “Neighborhood Takeover,” and related logos), is owned by HACJAC Capital LLC and protected by U.S. and international IP law. We grant you a limited, non-exclusive, non-transferable license to use the platform for your business while your account is in good standing. No other rights are granted.
If you provide feedback or suggestions, we may use them freely to improve the product, with no obligation to you.
9. Termination
- You may cancel anytime from account Settings or by emailing h@hacjac.com. Cancellation takes effect at the end of the current billing cycle.
- We may suspend or terminate accounts for non-payment, acceptable-use violations, or legal requirement.
- On termination, your data handling follows the retention schedule in the Privacy Policy. You may export data up to the effective termination date.
10. Disclaimers
The platform is provided “as is” and “as available.” We disclaim all implied warranties — including merchantability, fitness for a particular purpose, and non-infringement — to the fullest extent permitted by law.
Automations act on your behalf. You are responsible for reviewing what the platform is configured to do before enabling it. We strongly recommend running new automations in test mode before pointing them at real customers.
11. Limitation of Liability
To the maximum extent permitted by law, HACJAC Capital LLC’s total liability arising out of or related to these Terms or the platform will not exceed the fees you paid in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages — including lost profits, lost revenue, or lost data — even if advised of the possibility.
12. Indemnification
You agree to defend and indemnify HACJAC Capital LLC against any claim arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of a third party’s rights, including privacy and IP rights; or (d) the content of the messages you send through the platform.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Butler County, Ohio, and both parties consent to jurisdiction there.
14. Changes to These Terms
We may update these Terms as the product evolves. Material changes will be emailed to account owners at least 14 days before taking effect. Continued use after the effective date means you accept the updated Terms.
